Government Moves To Seize NXIVM Headquarters And Other Real Estate – And Whatever The Vanguard May Own

In General

One thing you have to acknowledge about the U.S. criminal justice system is that once it decides to go after someone, it can completely and utterly destroy them.

Overcharging Of Offenses
First, comes the over-charging of offenses – which can turn just about any minor crime into a potential 20-year sentence.

This usually involves the addition of related crimes like “Conspiracy To ____” – and the all-time favorites of federal prosecutors: Bank Fraud, Mail Fraud, and Wire Fraud.

The overcharging leads to plea deal offers that, given the alternative, many defendants accept regardless of their guilt or innocence.

Three years in a minimum security prison is a lot more doable than twenty years in a maximum security facility.

*****

Pre-Trial Incarceration
Next comes the pre-trial incarceration of the defendant – which usually cuts off all sources of their income and makes it difficult, if not impossible, for the person and their attorney to put together a decent defense.

This is especially effective where the defendant has a family – and even better when there are young children involved.

*****

Tactical Delays
Then we have the tried-and-true pre-trial delaying tactics: e.g., unnecessary motions; delays in turning over evidence; superseding indictments, etc.

These pretty much ensure that by the time a trial gets started, the defendant has been at least somewhat demoralized – if not totally traumatized – by the time spent in prison.

Usually, I rail at these tactics as being abusive and unfair.

And then along comes a case like Keith Alan Raniere AKA The Vanguard – and I think the system is just fine.

The reality, of course, is that the U.S. criminal justice system has become totally out-of-balance in favor of the prosecution.

Few defendants in criminal matters actually go to trial.

According to a 2012 New York Times article, 97% of federal criminal cases – and 94% of state criminal cases – end up in with a plea bargain.

The current case of the U.S. v. Raniere Et Al pretty much reflects how the U.S, criminal justice system works.

Five of the six co-defendants pleaded out rather than go to trial.

And those people had a $14.3 million Defense Trust Fund at their disposal.

*****

But now comes the fun part.

As the government is bringing its case to a close – and anticipating a guilty verdict for The Vanguard – it has unleashed another of its weapons: Criminal Asset Forfeiture.

According to filings that were made yesterday, here are some of the assets that the government plans to seize in conjunction with this case:
(1) The real property located at 8 Hale Drive, Halfmoon New York 12065, together with its respective buildings, appurtenances, improvements, fixtures, attachments, easements and furnishings;

(2) Fifteen thousand six hundred seventy dollars and zero cents ($15,670.00) in United States currency seized on or about March 27, 2018 from 3 Oregon Trail, Waterford, New York 12188;

(3) Three hundred ninety thousand one hundred eighty dollars and zero cents ($390,180.00) in United States currency seized on or about March 27, 2018 from 3 Oregon Trail, Waterford, New York 12188;

(4) One hundred nine thousand seven hundred twenty-seven dollars and zero cents ($109,727.00) in United States currency seized on or about March 27, 2018 from 3 Oregon Trail, Waterford, New York 12188;

(5) The real property located at 7 Generals Way, Clifton Park, New York 12065, together with its respective buildings, appurtenances, improvements, fixtures, attachments, easements and furnishings, and all proceeds traceable thereto;

(6) The real property located at 455 New Karner Road, Albany, NY 12205, together with its respective buildings, appurtenances, improvements, fixtures, attachments, easements and furnishings, and all proceeds traceable thereto;

(7) The real property located at 457 New Karner Road, Albany, NY 12205, together with its respective buildings, appurtenances, improvements, fixtures, attachments, easements and furnishings, and all proceeds traceable thereto; and

(8) The real property located at 449 New Karner Road, Albany, NY 12205, together with its respective buildings, appurtenances, improvements, fixtures, attachments, easements and furnishings, and all proceeds traceable thereto.

Keith Raniere maintained a private townhouse at 8 Hale Drive for mentoring female students. The townhouse, which is referred to as ‘The Library’, has a commodious hot tub which is said to relax the female students who Raniere consents to teach.

The New Karner Road properties were used by NXIVM for its various business operations.

8 Hale Drive was Raniere’s sex lair.

And the 7 Generals Way property has been previously described as a townhouse that was purchased by Allison Mack.

Allison Mack’s townhouse at 7 Generals Way

Lauren Salzman and Allison Mack have already agreed to the government’s seizure of all those assets.

It is expected that similar agreements will soon be forthcoming from Nancy Salzman, Clare Bronfman, and Kathy Russell.

After all, who wants to go to their sentencing hearing while they’re fighting over these assets with the government?

*****

And as for The Vanguard, the self-proclaimed renunciate who claimed not to own anything or have any assets.

Looks like he’s going to turn out to be correct on that claim.

Yesterday, the prosecution also filed another motion to have Judge Nicholas G. Garaufis be the one to determine the amount of the forfeiture money judgment that will be imposed on Raniere if he’s convicted on any of the seven counts he’s currently facing.

At a minimum, the government will seek to have Raniere stripped of any rights he may have in the above-listed assets.

And it’s possible that the government will seek to claim any other assets that, despite his claim of being a renunciate, Raniere has accumulated over the years.

That could include anything he may have been bequeathed by Pam Cafritz and Barbara Jeske.

*****

All of the seized real estate assets will be sold at auction by the U.S. government. The proceeds from those sales – plus all the seized cash – will be retained by the government.

  • YES! Going after Nxivm assets can cripple this organization. Putting them out of business is job 1. It’s a criminal operation. RICO was breakthrough legislation, it goes after a criminal gang’s assets; there’s not much point putting the people in jail if the operation continues, waiting for them to get out and resume business as usual.

In this case, pretrial incarceration was justified. Raniere fled to Mexico to evade arrest, he was a flight risk. Ditto Mack’s unusually strict bail requirements, she fled the country with him.

    • orangecountydreams - OCD

Agreed. And RICO was designed to target mafia mob bosses who “kept their hands clean” by verbally ordering others do all the dirty work on their behalf. And due to the stiff penalties available, prosecutors were able to break through “Omerta” (the code of silence that stymied convictions of the higher ups prior to that).

Keith instructed others to do a host of horrible things on his behalf, including harassment, vandalism, extortion, money laundering, tax evasion, bribery and much more. So he richly deserves whatever he gets out of this, IMO.

    • RICO’s asset forfeiture is designed to teach criminals that CRIME DOES NOT PAY.
In the NXIVM case all of the defendants are HARD CORE CRIMINALS.

      • Shadow,

        Reread the fourth amendment.

BTW throughout the Midwest and Southwest, asset forfeiture is abused by county Sheriffs departments.

        • The probable cause provision. There’s ample probable cause in this case.

          • Thanks, Acteon. I was referring to Shadowstate’s first sentence.
            ********

Unfortunately for you Acteon, the 3rd Amendment only refers to the billeting of troops in your home and not the gangbangs your wife has 🙂

          • Tomorrow Night Cancelled

            Shouldn’t have told him

        • I have no problem with asset forfeiture if the defendant in the case is actually convicted of criminal acts.
The main problem with asset forfeiture is where the government seizes the property and makes the owner or owners prove that the seized property is not the result of criminal behavior.

  • What overcharging of offenses do you think the government did in the case of the 5 who pleaded out?

Assuming someone like Allison Mack purchased her home with money she earned legally through her acting / appearance gigs, what justification does the government have for seizing her home?

    • I was talking in general terms about the U.S. criminal justice system, not this particular case. But I do think that based on the evidence presented to date, the Racketeering Conspiracy charge against Kathy Russell – and the Racketeering and Racketeering Conspiracy charges against Clare Bronfman – were a bit over the top. I’m not saying you can’t make a case for those charges based on other evidence. But based on what’s been introduced so far in this case, I think those charges were inflated.

      • Actually, not that much for Russell (she was implicated in a lot of crimes)

Bronfman was not as implicated and Mack wasn’t implicated in anything she was accused (nor pleaded)

The extortion is closer to blackmail than extortion (she didn’t even threaten anyone), The forced labor is absurd at best (Agnifillo pointed Something true: The victim expects Allison to pay for her service but it’s completely normal that Allison was not paid when She helped)…

I’d say that the overcharging is definitely real when it comes to Allison (and seeing how the trial got, I’m confident that Allison would have been better going to the trial…)
At least she would have been allowed to give her side of the story and the judge would have been reminded that Allison was exactly in the position of the other who explain their “acceptance” to do certain things because of the collaterals.
        She was coerced.

  • Most Americans do not understand that according to a 2012 New York Times article, 97% of federal criminal cases – and 94% of state criminal cases – end up in with a plea bargain.

  • Krclaviger,

A while back you and Frank both stated your beliefs that Raniere personally had millions, maybe as much as 16 to 20 million, stashed away

Has there been any mention of Raniere’s millions by the DOJ?

    • I believe you and Frank are correct. Just eyeballing the prices of the houses and real estate leaves out millions.

If I , a lay person can do the math I am sure the federal government has as well.

      Hence the question:

      Where are the millions?

      • The FBI should check for diamonds hidden in the seams of Nancy Salzman’s corsets and girdles.

Also, Clare Bronfman might have made it disappear into offshore ‘banks’ she knows about and uses.

        • HA HA Paul,

However, Frank and Krclaviger both stated they believed there were millions secreted away.

I remember because I asked them the question of how much unaccounted money they believed was hidden from the IRS.

          Perhaps their estimates were off.

I can’t fault them for that.

Frank helped to get the branding story published.

The NY Times branding article was the true catalyst for the FBI investigation and the prosecution.

The government could no longer ignore NXIVM.

          • K.R. Claviger

Based on information in various court records and other publicly available information, I have made several estimates regarding NXIVM-related financial matters (Note: Although I consider these to be informed estimates, they are, nonetheless, ESTIMATES). Among those are the following: Unpaid Taxes: $200 Million; Unaccounted For Income: $10-$20 Million; Unaccounted For Clare Bronfman Funds: $150-$200 million.

It would probably take a team of forensic accountants several years to track down all these funds. So, unless the IRS gets involved in this case, it is unlikely anything will ever be done about these matters.

          • Krclaviger,

I greatly appreciate your response and saved it.

            Thanks!

          • I suspect NXIVM wasted more money than anyone could have realized, and has little left. Scammers of various sorts often, almost typically, plan less for things to fall apart, than might be expected.

However, I’d expect the IRS to levy some stiff assessments against anyone with assets left – like the Bronfmans.

        • “Clare Bronfman might have made it disappear into offshore ‘banks’ she knows about and uses.”

Between Raniere’s arrest in March, 2018 and the arrests of the rest of the defendants in July 2018 there were stories of the Bronfman private jet flying to the Bahamas, a notorious off-shore banking center.

      • Isn’t there an island in Fiji?

  • There have been a number of stories on the Frank Report about Allison Mack’s bogus acting school The Source.
One of these stories was written in part by me.

Right away I saw that The Source was a money raising scam run by and for Allison Mack.
One of the first stories about Mack’s Acting School scam, written by Frank Parlato, described how Mack and Brandon Porter were tag-teaming a teenage girl to sign up for summer school.

How Dr. Porter and Allison Mack worked to recruit a teenage girl to the sex slaver cult of NXIVM
    https://frankreport.com/2018/05/19/how-dr-porter-and-allison-mack-worked-to-recruit-a-teenage-girl-to-the-sex-slaver-cult-of-nxvm/

At the time, I quickly researched the prices of acting schools in or near New York City and found that Allison Mack was charging far more than already established acting schools.

It is $8,000 until April 18.
$8,000 to $10,000 for acting lessons with the Sarah Bernhardt of our time,Allison Mack.
    “Superman, save me!”

What does the Stella Adler School charge teens?
    From the Stella Adler website:
Teen Summer Conservatory – Now Enrolling!
    5 Weeks -$3,250
    Monday-Friday, 30 Hours a Week

But I’ll bet Stella Adler doesn’t teach about female empowerment through sexual slavery.

Various courses and programs at Stella Adler studios (Brando, Deniro etc.) range from $700 to $ 2,600. Does anybody think that Lollipop Head, i.e. Scout Mack, was going to produce the next Brando?
    ——————————————–
In December I wrote a short piece about how the FBI should investigate Mack’s bogus “The Source” Acting School.

Shadow State: FBI should investigate Allison Mack’s acting school
    https://frankreport.com/2018/12/20/shadow-state-fbi-should-investigate-allison-macks-acting-school/

Now after the clear testimony of both Witness “Nicole” and Witness “Jaye” it is abundantly apparent that Allison Mack’s “The Source” was also a means for Allison Mack to recruit women into the NXIVM DOS sex slave cult.
The Source was a means for Allison Pimp Mack to groom women for sex trafficking under the guise of being a Dramatic Arts school.
No one can beat Allison Mack for deviousness and guile.

The FBI should use RICO to confiscate all of the proceeds that Allison Mack gained through her criminal activities as head of The Source.
If necessary file a civil suit to force Mack to cough up the money.
RICO would allow for treble damages.
And the money should be refunded to the students who were suckered into Allison Mack’s bogus school.

  • I think this is bullshit. Remember they destroyed hundreds if not thousands of lives (and the only reason we don’t know is because those people are still too broken to speak).

The criminal system is too easy on criminals. It’s typical that someone who steals 20M would get a 2M fine. Crime is beneficial and that’s why so many smart people do it.

As for pretrial incarceration, it only happens when the criminal is going to flee (Keith) or is rampaging in the community (also Keith).

  • That’s ok, as vanturd has said in the past whenever he needs anything, it will just appear.

  • I note that the Apropos facility is not on the list. Wonder why that’s not mentioned. It’s probably worth more than any of the residential real estate they’re intending to take.

    • Its formal address appears to be 1475 U.S. 9, Clifton Park, NY 12065

The Saratoga County Assessment Database actually has it in Halfmoon, at an address of 1475 Route 9:

      Ownership Information
      Name Address
Village Hall LLC 5 Southside Dr 228
      Clifton Park NY 12065
      Sale Information

Sale Date Price Property Class Sale Type Prior Owner
      8/17/2012 $975,000 421 – Restaurant Land & Building NXV Trust

It appears that a NXIVM-connected entity bought it only a month earlier from an owner of 6 years, in one of those curious $1 transactions:

Sale Date Price Property Class Sale Type Prior Owner
      7/25/2012 $1 421 – Restaurant Land & Building Arrington, Stephen L

NY state corporation records show that Village Hall, LLC was incorporated in 2008, and uses that same 5 Southside Drive address – but with no Registered Agent listed.

However, 5 Southside Drive #228 shows up as also associated with Precision Development LLC – which if I recall, is a Bronfman real estate development company, and indeed shows up in a California filing as a Nevada-based corporation with Clare Bronfman as Manager.

So maybe it’s a Bronfman asset, not a NXIVM one.

      Cheers! PM

    • Sara and Clare Bronfman are the owners of Apropos via Village Square LLC. My guess is any asset forfeiture surrounding Clarebear either is still in the works or will not happen. They also owned 3 Oregon Trail where Nancy Salzman resided prior to her arrest.

  • 7 Generals Way has a curious history. Some reports say Mack moved to Brooklyn when she left Smallville in 2011, but she bought it in October, 2011, though apparently she also had Vicente and his wife as roommates at one point, and then eventually moved somewhere else herself; in January, 2016 it was listed for rent for $2,175/mo by the NXIVM-connected Armida Rose Brokerage.

    Vicente’s testimony:

“Q And where did Allison Mack reside in Clifton Park?

A …she moved into 7 Generals Way, … along with my wife and I.

    **

Q Did you stop living with Allison Mack at 7 Generals Way?

    A Yes.

    Q What happened?

A She had said at one point she needed to do some more private work and she needed to be alone. So she moved a few blocks away to Grenadier Court,…. She said she needed privacy to do some of the different projects she was working on.”

I thought the hot tub at 8 Hale Drive had crashed through the second floor, making the house potentially condemned. And yes, I was curious about the Apropos property as well. And what about Flintlock Lane?

As to the residential properties, they will have to bring in a Hazmat crew to sterilize. I wouldn’t buy a house that KAR had resided in if it were listed for $100.

    • There are many other properties owned by NXIVM-related entities. Their fate has not yet been determined.

    • Light at the end of the Tunnel

I believe Flintlock is owned by Karen Unterreiner. Since Karen has not (yet) been charged with a crime, she’ll get to keep the whore house for now.

      • It’s jointly owned:

Sale Date Price Property Class Sale Type Prior Owner
        8/1/1987 $90,355 210 – 1 Family Res Land & Building The, Michaels Group

  • K.R. Claviger, did the innocent Doctor get her rented out property removed from this list?

  • If the courtroom is filthy, just think how nasty all of these properties are. These places may be worth more as horror attractions than as homes and offices. Dress up the paying customers with anti-contamination clothing and post all of the Frank Report stories throughout the properties.

  • I don’t like quite a lot of these features of the US legal system, most of which we do not have here in the UK. However, the US and UK are heaps better than many others places from China and Russia to Japan and North Korea so it is only a minor moan I would have about some of the features which are bit over the top and balance things against justice in a good few cases because of the huge pressure to do a plea bargain.

  • I imagine the non NXIVM members in the neighbourhood will be pretty relieved.

    • From reports, there are still a bunch of diehard NXians running around Karner Woods, creeping out the neighbors. Hopefully, the Albany-area authorities will now do something about the remaining miscreants – and hopefully, the neighbors will help put pressure on local prosecutors.

      • I wonder if Nicki Clyne is there… Or maybe in Mexico. She is one of the diehards who will try to keep whatever is left of the cult alive.

hootsuite is a computer company based in Vancouver but with offices in several cities.

Hootsuite is a social media management platform, created by Ryan Holmes in 2008.[6] The system’s user interface takes the form of a dashboard, and supports social network integrations for Twitter, Facebook, Instagram, LinkedIn, Google+ and YouTube.

Additional integrations are available via Hootsuite’s App Directory, including Reddit, Storify, Tumblr, and Marketo.[7]

Based in Vancouver, Hootsuite has close to 1,000 staff members in 13 locations, including Toronto, Bucharest and Mexico City.

  • I intend to show up at the government auction and to purchase, at bargain rates, the residences at 8 Hale Drive and 7 Generals Way.

I will then open up a museum.

  • I like this part in items 5-8 above, “…and all proceeds traceable thereto.” I believe this means all of the money that came in to pay for NXIVM classes.

  • GET A HOT TUB!
    GET BRANDED!

Old’uns who grew up in NY will get that…

Is the Halfmoon property where Nancy is living?
Great that the federal gov’t is taking the business properties on Karner Rd also.

Say, Barb, cause I know you read Frank’s blog, seizure of these properties on Karner road puts a dent into your grand plans for the resurgence of NXIVM brought by YOU!

Pardon me while I vomit here.

Say, Barb, did it ever occur to you that a complete stranger, that’s me, can see right through you and detest you so much? Think about that. I am one of many who do so.
Kind of stupid of you to repeatedly portray yourself as a victim, doing interview after interview and dominating the TU event.
I was there. I saw it happen. Man, you grabbed that mic as if we came to hear you pontificate.

I am one of many so glad that everything will be seized and auctioned off.

As for the best of NXIVM? It never existed. You and the others aligned yourself with a sexual sadistic pedophilic megalomaniac.

Barb, it is said that all one leaves behind is one’s reputation. I think you would better serve yourself by disappearing into the crowd and performing charitable works the rest of your life and forget about rehabbing NXIVM.

  • In years to come, I envision a reunion of sorts among the NXIVM 9 as they are called.
One would love to be a fly on the wall then.
Listen to them reminisce about the good old days, when they were free to brand, imprison, impoverish, starve, abuse and mentally torture their sisters.
I can envision them.now. All smiles, laughing and joking how they once were royalty “cough cough”.
Bad ass feminists my ass! Sadists, each and everyone who delighted in it.

  • Obsessed with this trial

You bloggers are the best! How I’m going to miss obsessing over this very case! A lot of you are well versed and seem very candid. Thank you for your freedom of expression and thank you, Frank, for creating this blog. I am tuned in to Frank Report and your entertaining and very driven followers. #imatruthfan
