Bouchey Was Not the Only One of the Nxivm 9 Threatened With Extortion

Barbara Bouchey made an on-the-record statement to Dianne Lipson, who has been providing excellent coverage of the U.S. v. Raniere trial for the Frank Report and The Underground Bunker, [operated by the world-famous Tony Ortega] that she was the only one of the NXIVM 9 who had been threatened with extortion charges when the group left NXIVM in April 2009.

As she explained, “A lot of people get confused on this point”.

As it turns out, – and Barbara may not know this – she was not the only one threatened with extortion by Nxivm. All the women in the Nxivm 9 were, in fact, threatened with extortion charges.

After communicating with other members of the group that collectively quit NXIVM in April 2009 following several days of face-to-face meetings with Keith Raniere, it appears the relevant facts are as follows:

– It was Barbara’s idea that the nine women should include a demand for any funds that were owed to them in their joint letter of resignation (That suggestion actually originated with Barbara’s psychic who was at the meeting with the other women).

– Barbara wanted to get back the funds that Keith purportedly owed her for his failed commodities trades and the unpaid commissions she was purportedly owed by NXIVM – and she wanted the Bronfman sisters to pay those amounts, plus the funds that were owed to several of the other women, as opposed to having the news of the nine women’s resignations become public just before the Dalai Lama came to town.

– The group sent two letters of resignation: one to Just Keith and Nancy – and one to the Executive Board of NXIVM.

– The letter to Keith and Nancy contained a demand for various funds that were owed to several members of the group – but the letter to the Board did not include that demand.

– The day after sending the two letters, the group got together again at Barbara’s house. While they were meeting, they were all served with a letter that claimed their demand for the funds owed amounted to extortion – and that NXIVM was going to seek to have them prosecuted for that crime.

– Barbara decided that she needed to immediately hire an attorney to protect her from what would turn into protracted litigation with NXIVM and her soon-to-be former clients, Clare and Sara Bronfman.

– Susan Dones, who had organized and filmed the face-to-face meetings with Raniere, offered to hire an attorney to represent herself and the other seven women.

– Susan subsequently hired Terence J. Devine from the Devine, Markovits & Snyder LLP law firm to represent the NXIVM 8.

– Thereafter, Susan and other women met with Devine – and were assured by him that what they had done did not constitute extortion. He then called Steve Coffey to confirm that no criminal complaint was going to be filed against them.

– And – surprise, surprise – Coffey responded by telling him that he thought the women’s demand to be paid for funds they were owed did constitute extortion and that his clients, NXIVM and the Bronfman sisters, would be seeking to have criminal complaints issued against all of them.

– Thereafter, Devine contacted Coffey on several occasions to try to work out some sort of settlement with the NXIVM 8 (See letters from Devine to Coffey and to the NXIVM 8 below).

– Coffey, however, refused to even give the courtesy of a reply to Devine’s letters (Such a class act!).

– Susan, as she had done before – and as she would go on to do many more times – finally called “bullshit” and advised the other women that there was little, if any, chance of them ever being charged with extortion.

– When asked by the other women what they should say if they were questioned by anyone about the matter, Susan responded with her usual straightforward approach to such things:

“I’m going to tell anyone who asks that even though all I did is make a demand for funds that I’m owed by NXIVM, I’m not surprised that Keith Raniere is trying to get us charged with a crime. He’s done that before – and he’ll probably do it again – because NXIVM is, in fact, a criminal enterprise that operates under the guise that’s it’s a self-help training program”.

– None of the women were ever charged with the crime of extortion.

– NXIVM, however, did attempt to assert a civil extortion claim against Susan and Kim Woolhouse in their subsequent bankruptcy case. That charge – like all the other charges that NXIVM attempted to assert in that case – was dismissed when NXIVM refused to turn over any of its financial records to the court.

While Barbara Bouchey was threatened with extortion, she was not the only one threatened. We’re certain Barbara will appreciate this clarification.

By the way, none of the Nxivm 9 were actually charged with extortion. Devine was right in advising the other eight women that their conduct did not constitute the crime of extortion and they were not going to be charged.

It is also fair to point out that none of the women got any of the money they demanded from Raniere and Salzman or the Bronfmans.

Dear Keith & Nancy,

What predicated our meetings with Keith on April 21, 22 and 23, 2009 was the growing number of NXIVM community members expressing their concerns about the inconsistencies we are and have been experiencing in how the company operated. Upon sharing data, the damages are more far-reaching than originally thought.

As we compared our data of why the system wasn’t working we identified evidence of secrecy, nondisclosure, and lack of transparency.

Our intent for meeting with Keith was to rectify the inconsistencies in the leadership of the company and the conflict of interest within the system.

Keith’s willingness to meet with us was based in part on his opinion of the organization’s ethical breach against its members because its system of protocol and feedback failed. We concluded at the end of these meetings that resolution was not probable.

Based on the above, we believe we can no longer continue a business relationship with ESP/NXIVM.

Therefore, we are requesting the closure of outstanding value exchanges not met as well as the buyout for the Tacoma Center for the people mentioned below.

We are requesting a response to this letter by 11:59 PM, Saturday, April 25, 2009. We are requesting a written, signed, notarized contract agreeing to the below amounts by 11:59 PM, Sunday, April 26. 2009.

We are requesting a Cashier’s Check for the total amount due of $2,088,000 by Thursday, April 30, 2009.

If these requests are not met, we will move forward by contacting the Press.

Dear Mr. Coffey:

This office has been retained by Sheila Cote, Nina Cowell, Kathy Ethier, Ellen Gibson,
Jan Heim, Susan Dones, Kim Woolhouse and Angela Ucci in connection with the termination of
their relationship with NXIVM and related matters. I know that you have contacted them, but,
now I must respectfully request that all communications come through this office. You are no
longer to communicate with them or harass them in any way.

Our goal is simply to make these women whole with respect to monies due them, recover
their personal files, clarify any ongoing obligations between and among the parties, and allow the
parties to move forward with their lives. With even marginal cooperation, we should be able to
satisfy our goal and move on.

You continually allude to threats being made by my clients and defamatory statements
being made by them. In this matter, you will have to keep separate issues you may have with
other individuals previously associated with NXIVM from my clients. My clients are not
threatening NXIVM in any way and are not engaging in any defamatory conduct. Based on
reports I have heard, I am not sure that the same can be said for your clients, and I must
respectfully demand that any such conduct engaged in by your clients against mine cease
immediately. Again, my goal is to disentangle the parties, not engage in time-consuming, costly
litigation.

A few monetary issues must be addressed. At the conclusion of this relationship, any
remaining open accounts (monetary or exchange) shall be null and void. At least 3 of my clients,
Susan Dones, Kim Woolhouse and Angela Ucci, are entitled to commissions for work while they
were still with NXIVM. Moreover, Nina Cowell is owed substantial compensation for the work
she has done for NXIVM. I’m sure it is not your intention to withhold their wages, or to attempt
to offset unrelated claims, whether manufactured or otherwise, against wages. Such an offset
would clearly be inappropriate. Payment should be arranged as soon as possible.

You have also demanded the return of certain intellectual property allegedly belonging to
NXIVM. My clients have no intention of appropriating anything from NXIVM. You can
arrange to have material picked up, at the expense (including all copying expense) of you or your
client. You can coordinate your efforts through me.

Finally, you have suggested my clients may be bound by non-disclosure agreements or
non-competition agreements. Please provide copies of all such agreements in existence to me so
that discussions can be made regarding permissible conduct. Also, your client is holding the
student files for each of my clients. These contain personal information relating to my clients
unrelated to the NXIVM business of properties. These should be forwarded to me immediately.

Your letters continually threaten judicial intervention. While that is clearly your
prerogative, this matter can quickly be dealt with between counsel on an amicable basis to save
all parties unnecessary aggravation and expense. If you have any questions regarding any of the
above, please contact me.

He has been completely unresponsive to my correspondence. As I’ve indicated previously, he

    The readers should know that when it comes to posts about me, rarely – if ever – am I contacted for my side. In my opinion, failure to do so and or research the facts fully is unfair and poor journalism. To print this post leads the readers to believe it is the truth, which it is not. I do not have time to address the many inaccuracies, facts omitted, and blatant false statements made by Susan Dones, who is clearly he source as I’m leaving for court. But, I will address one thing, which is what I said to Dianne Lipson, and to Susan via test yesterday.

    After Mark’s testimony regarding the Saratoga DA extortion letter written by him and apparently many members, Dianne expressed how awful this attempt was to have the NXIVM 9 arrested for extortion. I clarified that the Saratoga DA letter only referenced me, not the entire NXIVM 9. In Dianne’s article for Tony Ortega yesterday, she made reference to this clarification, however, this statement was removed last night, which I assume occurred after Susan had a communication with someone.

    Yesterday, Susan sent me this text with a link to Dianne’s article:

    Susan: “What is this about- How fast you forget that I hired an attorney for all the rest of the NXIVM nine to deal with the extortion threat made against all of us while you hired tour own.”
    Barbara: “As usual, you accuse me instead of asking for my side or the facts. Herein are the facts, and it’s untrue what you are accusing me. Please do not ever insult me or accuse me again. Should you want to be curious about something, then simply ask.

    Barbara: “Mark’s two page typed letter to the Saratoga Springs DA’s Office asking to have me arrested was put on the courtroom TV monitor and then Keith’s Attorney asked Mark questions at length about it – even reading excerpts from it. There was a break after this and a person who writes for Tony Ortega stated how awful this attempt was to have the NXIVM 9 arrested. I corrected them saying this letter to the Saratoga DA was to only have me arrested. Per Mark’s testimony he stated the letter was a template letter created by Nancy and Kristin with blanks for members to add more to it of their own personal knowledge of bad things I did and damage caused them and NXIVM- and then to sign it. Mark also testified that many NXIVM members used the same template writing letters as well.”

    Barbara: “I received a letter from the Saratoga DA back then in regards to this, and it was my attorney who handled the matter and the investigation never got opened. I further explained I was a resident and business owner in Saratoga, which is why they approached that DA.

    Barbara: “I learned about this template letter from Nippy last year when he called to apologize for having been one of those members writing a letter, and how ashamed he feels now for having participated in this. That’s the dialog I had with that person (Dianne Lipson) which differs from what you are saying and accusing me of. Here is the original template letter so that you can read for yourself. As you can see, the NXIVM 9 is not mentioned anywhere in the letter.”

    Susan did not respond to my text, which is not unusual from my experience over the years when the clarification or facts prove her wrong.

    When not hearing from her, a little while later I texted Susan this:

    Barbara: “There were several other govt agencies including my CFP Ethics Board who also approached me about Clare Bronfman’s attempt to have a criminal investigation for extortion against me. All matters were handled by me and my attorneys. I am not aware of any government agency officially trying to open a criminal investigation for extortion against anyone in the NXIVM 9 nor them being contacted – other than me. Yes, It was mentioned in your bankruptcy court, but that’s not an official govt agency trying to open an investigation. The only exception is the Mexican extortion charge filed in April 2016, which includes both our names, which I always fully state whenever asked. I am the only one, however, that received two letters from the NYC Mexican Consulate’s Office, and am not aware that you received anything. If you know of any government agency you or any of the NXIVM 9 was contacted by – then please let me know as I’d like to be informed and to state facts as accurately as possible.”

    There are more inaccuracies in what Susan provided for this post, but I do not have time to clarify. I may not further clarify because this type of thing has been going on for ten years now, and it is traumatic for me to read, and or, to respond. Further, Susan’s rendition regarding the NXIVM 9 confronting and filming Keith for 10.5 hrs is also false. Angela Ucci, a witness to this, made a comment correcting Susan’s version – and – there are 5 witnesses who can attest to it as well.

    For the future, I respectfully request that you contact me for my side and or supporting facts. Otherwise, posts like this continue to be one-sided, riddled with false facts, and portraying me negatively only causing me further damage.

    • I withdraw my point that these women should have worked together a decade ago when they left NXIVM. It’s obvious they are selfish and dysfunctional. Dones even threatened Barb not to release the 10.5 hour video and said she would not release it, either. These women dug their own graves as well as the graves of many other future NXIVM victims. They should all be massively ashamed of themselves, but that’s not an allowed feeling in NXIVM.

      • It does appear that they continue to think and act as taught by NXIVM. I mentioned before the continuation of the vocabulary in their post and comments and as time goes on it’s seen in their actions and mindset of dealing with those here commenting and the trial.

        I think you are correct that it’s also a clear example of why and how they became a part of the community.

        I have always been skeptical but maybe a deprogrammer or therapist is necessary for each and every one. Separation doesn’t seem to be enough.

        • Actually, I was thinking more like typical, back-biting women. Raniere’s big mistake was thinking he could keep a gaggle of women from flapping their jaws. Talk about the self-proclaimed smartest man in the world falling far short of that claim.

        Why are these videos so important to you- There is plenty of good information about this creep coming out in the trail-

        • I’m talking about a decade ago, not for the trail [sic]. Think about how the NXIVM 9 could have blown up NXIVM had they worked together back then and saved a full decade of additional abuse.

            No one was going to blow up NXIVM but the authorities. It wasn’t because people set back and did nothing.

            Many people talked to several people from many branches of the government through the years. Long before the NXIVM 9 and long after. No branch did anything until 2017 when the story broke via the Frank Report that Raniere had started DOS.

            Not the FBI, not the NYAG office, not the county DA’s, not the state police, not the IRS, no one seemed to care.

            From time to time, the media would jump in and write stories and that didn’t get any attention from the government either.

            If you go back and read the 2012 Times Union four-part series on Raniere/NXIVM, that did not bring an investigation.

            You, of all people, should understand how hard it is to get any government institution to take a look at any company that has clout behind it.

            It wasn’t from a lack of trying, there were many of us who never gave up and continue to stick our necks out. it was a lack of caring on the authorities side.

            Some in the NXIVM 9 wanted to go live their lives and not risk any legal action. Some didn’t get along but they found others they could work with and did.

            The reality is it took what it took to blow them out of the water. Now the top tier has been indicted, five have pleaded guilty, and one is on trial.

            The good news about Raniere not having a plea deal is all this information is coming out.

      And here you are again in one of your drop-in-when-I-feel-like-it kamikaze attacks, this time on Frank and Susan.

      Given your track record – or lack thereof – I don’t really expect you’ll answer any of these questions. But I’m going to ask them anyway.

      (1) Why is it that so many former members of NXIVM have issues with you- While some other former members certainly have some detractors – e.g., Mark Vicente, Sarah Edmondson, etc. – you seem to have dozens of former members who don’t trust you, who think you always try to claim more credit than you’re due, who resent that you still insist that the NXIVM “tech” was a good thing (at least while you were there), etc.-

      (2) Why did you stop answering questions from Frank Report readers when they pressed you for more details or asked harder questions – e.g., how much you earned from managing the Bronfman sisters funds; how many other clients besides the Bronfman sisters you got from being one of the high-rank members of NXIVM and how much you earned from them; why you chose to stay involved with Raniere after you found out he was sleeping with anyone else; why you didn’t intervene when you realized that Raniere was sexually involved with a 15-year old; whether you required people who worked for you to enroll in NXIVM classes; etc.-

      (3) Why will you not detail the specifics of all the lawsuits you claim to have been dragged into by NXIVM: i.e., the name of the case, the court, whether you were a defendant or a witness, etc.- Is it because your claims about such matters are grossly overstated-

      (4) Why do you not acknowledge the fact that you were involved in trying to get Toni Natalie, Rick Ross, Joe O’Hara, and John Tighe indicted on various bogus criminal charges- Have you forgotten your own role in some of NXIVM’s nefarious activities – or do joust want everyone else to forget about that stuff-

      (5) Why don’t you ever own up to the fact that you used to make many important decisions based on the information you got from your psychic- Do you no longer believe in the powers of psychics or do you have a new one-

      Put you big girl pants on, Barbara, and respond to readers’ questions or stop sending in whiny comments when you don’t like what people say about you here.

    Legal advice from your Psychic is dubious.

    • Asking for money owed is not extortion and going to the press about resigning is not against the law. If it would have been, every one of those women would have been arrested.

      Having a psychic present that’s a bit odd. Who’s idea was that- It had to have been someone local or did they call 1-800 psychic-

    • Yes, any UK and probably US attorney would have made her take that bit out. There are other ways to say it more lawfully.

      That does not of course mean she was not entitled to repayment of loans and other sums clearly owed.

    Barbara should revive the teachings and make what’s good in the tech available to all. She was more knowledgeable than Vanguard. She should change the name and teach the tech. She is a very good woman.

    It appears this post is a clarification of a point or a counter point.

    Bouchey would have never made the debate team in high school or college; she’s too reactive.

    It appears Barbara Bouchey doesn’t like it when someone has a difference of opinion from her and attacks when others experience things from a different than her.

    What I have found amazing is how she goes up to anyone who looks like a reporter at the courthouse introducing herself as Keith Raniere’s one true girlfriend.

    Bouchey sits up extra tall whenever her picture or name is mentioned in testimony like being in NXIVM’S inner circle is something to be proud of.

    Makes me wonder what she really knows and what she did for her Master before she left NXIVM.

      In defense of Barbara, it sounds like she’s just trying to correct a misunderstanding. She’s been accused of claiming she’s the only one of the 9 that NXIVM came after legally. All she’s saying is no, I didn’t say that. What I said was this document they are showing in the court room was addressed to me and not to all of us. And that she’s the only one who they tried to get in trouble with the government. Sounds like she just doesn’t like words put in her mouth. And she also sounds like the one that received the worst of their legal wrath.

      Let’s just cut her some slack. And if she wants to queen about the court house and talk to people, where’s the harm in that- Who cares- Those 9 women should be supportive of each other. And be glad they were all smart enough to leave.

      How can you possibly know who in Raniere’s organization “suffered” the most-

      Guess everyone on the DOJ team is a great leader as they are the ones really standing up against Raniere.

      According to Bouchey conversation in the court house today with the poor man who couldn’t wait to get away from her exploration of his reason for being there, the DOJ is doing their job “all wrong”.

  • They should have spoken to a lawyer before sending that demand email as wording it differently could have helped their side eg deadlines are too short and the linkage of if you don’t do x I go to the press is often not lawful in many jurisedictions, whereas a demand letter for money owed is fine so a few tweaks and it might have gone better. However I don’t think KR/Nm would have paid quickly either way.
